The reason for this is also because on July 3rd, the Ministry of Commerce and the General Administration of Customs issued a notice on the implementation of export controls on gallium and germanium related items. Items that meet relevant characteristics shall not be exported without permission. It will be officially implemented from August 1, 2023. This includes: gallium related items: metallic gallium (elemental), gallium nitride (including but not limited to forms such as wafers, powders, and chips), gallium oxide (including but not limited to forms such as polycrystalline, single crystal, wafers, epitaxial wafers, powders, chips, etc.), gallium phosphide (including but not limited to forms such as polycrystalline, single crystal, wafers, epitaxial wafers, etc.) Gallium arsenide (including but not limited to polycrystalline, single crystal, wafer, epitaxial wafer, powder, scrap and other forms), indium gallium arsenic, gallium selenide, gallium antimonide. Due to the time required to apply for a new export license, it is expected that the export data of China’s forged and unwrought gallium in August will be 0 tons.
According to relevant news, the spokesperson of the Ministry of Commerce, He Yadong, stated at a regular press conference on September 21 that since the official implementation of the control policy, the Ministry of Commerce has successively received license applications from enterprises for exporting gallium and germanium related items. At present, after legal and regulatory review, we have approved several export applications that comply with regulations, and the relevant enterprises have obtained export licenses for dual-use items. The Ministry of Commerce will continue to review other licensing applications in accordance with legal procedures and make licensing decisions.
According to market rumors, there are indeed many enterprises that have obtained dual-use item export licenses. According to rumors, some enterprises in Hunan, Hubei, and northern China have already stated that they have obtained dual-use item export licenses. Therefore, if the rumors are true, the export of forged and unwrought gallium from China is expected to recover in mid September.
